1. Acceptance of Terms
By creating an account, accessing the Hey Olympia app, or using Olympia hardware, you ("you", "your") agree to be bound by these Terms and Conditions ("Terms"). If you are setting up this Service on behalf of another individual (e.g. an aging parent), please see Section 9 (Proxy Setup & Consent) for additional requirements.
If you do not agree to these Terms, do not use the Service.
2. About the Service
Olympia is an AI-powered conversational companion designed to provide companionship, conversation, and light assistance for older adults. The Service comprises the Olympia hardware device, the Hey Olympia app (for account management and setup by carers/family), and the cloud-based AI that powers conversations (together, the "Service").
3. Alpha / Early Access Programme
IMPORTANT: Olympia is currently in an early-access alpha phase ("Alpha Programme"). By participating in the Alpha Programme, you acknowledge and agree that:
The Service is under active development and may contain bugs, errors, or incomplete features.
Features, availability, and pricing may change at any time without prior notice during the Alpha Programme.
We may need to reset, modify, or discontinue parts of the Service as we iterate.
Your feedback during this phase is invaluable and we actively welcome it.
We will give you reasonable notice before making changes that materially affect your use of the Service.
4. NOT A MEDICAL DEVICE (Important Disclaimer)
OLYMPIA IS A CONVERSATIONAL COMPANION. IT IS NOT A MEDICAL DEVICE, A THERAPIST, AN EMERGENCY RESPONSE SYSTEM, OR A CERTIFIED LIFE SAFETY SYSTEM.
Specifically:
Olympia is not designed, intended, or authorised to diagnose, treat, monitor, or prevent any medical condition.
Olympia cannot contact emergency services.
If you or the primary user experiences a medical or mental health emergency, immediately contact local emergency services or a healthcare professional.
You agree not to rely on Olympia for any health, medical, or safety-critical advice.
4.1 Fall Detection & Sensor Features
Olympia may include optional convenience features such as fall detection alerts (powered by on-device sensors). These features are provided on a best-effort basis as convenience tools only. They are:
NOT certified personal emergency response systems (PERS);
NOT regulated medical devices under UK MHRA, EU MDR, or any equivalent framework;
NOT a substitute for professional monitoring, personal alarm systems, or carer supervision.
Fall detection may fail to detect falls, may generate false alerts, and should not be the sole safety measure for any user. We strongly recommend that vulnerable users have access to dedicated personal alarm or telecare services.
5. AI-Generated Content Disclaimer
Olympia's responses are generated by artificial intelligence. While we strive for accuracy, warmth, and helpfulness:
AI-generated responses may not always be accurate, complete, or up to date.
Olympia may occasionally produce responses that are incorrect, misleading, or inappropriate.
Olympia does not have professional qualifications and its responses should not be treated as professional advice (legal, financial, medical, or otherwise).
You should independently verify any important information provided by Olympia.
6. Subscription & Pricing
6.1 Free Trial
Alpha Programme participants receive 30 days of free access to the Olympia service from the date of device activation. During this period, all core features of the Service are available at no charge.
6.2 Ongoing Subscription
At the end of the free trial period, you will be invited to subscribe to continue using the Service at a fee to be communicated to you before the trial ends. Subscription details, including pricing, billing frequency, and auto-renewal terms, will be presented to you in-app before any charge is made.
You will not be charged automatically at the end of the free trial. You must actively opt in to a paid subscription. If you choose not to subscribe, the core conversational features of the Service will be deactivated, but you will retain access to your account and may export your data.
6.3 Cancellation
You may cancel your subscription at any time via the Hey Olympia app or by contacting support@heyolympia.com. Cancellation will take effect at the end of your current billing period. No refunds will be issued for partial billing periods, except where required by consumer protection law.
7. Hardware Warranty
Olympia hardware is covered by a limited warranty for a period of one (1) year from the date of delivery. During this period:
We will repair or replace (at our discretion) any Olympia device that is defective in materials or workmanship under normal use.
This warranty does not cover damage caused by misuse, accident, unauthorised modification, or normal wear and tear.
To make a warranty claim, contact support@heyolympia.com with your order details and a description of the issue.
This warranty is in addition to, and does not affect, your statutory rights as a consumer under the Consumer Rights Act 2015 or equivalent applicable legislation.
8. Acceptable Use
You agree to use Olympia only for its intended purpose as a companion device. You may not:
Reverse engineer, decompile, or disassemble the hardware or software.
Use the Service to generate illegal, harmful, abusive, or harassing content.
Attempt to bypass our security, authentication, or data protection measures.
Use the Service in any way that could harm, exploit, or endanger the primary user or any other person.
9. Proxy Setup & Consent
If you are setting up Olympia on behalf of another person (the "primary user"), you confirm that you have the primary user's informed consent to create an account and agree to these Terms and our Privacy Policy on their behalf, or that you hold a valid Lasting Power of Attorney (or equivalent legal authority) that authorises you to do so. Both you and the primary user may independently exercise rights under our Privacy Policy, including requesting data deletion.
10. Accounts and Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time via the in-app settings or by contacting support@heyolympia.com. Termination will trigger the deletion of your associated personal data in accordance with our Privacy Policy.
11. Intellectual Property
All intellectual property rights in the Olympia service, app, hardware design, and AI models are owned by Reminiscentia Inc. or our licensors. These Terms do not grant you any rights to use our trademarks, logos, or branding without our prior written consent.
12. Limitation of Liability
To the maximum extent permitted by law:
Reminiscentia Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including but not limited to any failure of fall detection or other sensor features.
Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you have paid to us for the Service in the 12 months preceding the claim, or £100, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Hey Olympia app at least 30 days before they take effect. Your continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may terminate your account.
14. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in the European Union, you may also benefit from mandatory consumer protection provisions of the laws of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.
